Court of Appeals reinstates Dominga’s RCA

The Antofagasta Court of Appeals ruled to accept for consideration a cassation appeal filed by the Union of Independent Artisanal Fishermen of Totoralillo Norte and to suspend the effects of the judgment handed down on February 20, a decision that effectively reinstates the validity of the Environmental Qualification Resolution (RCA) for the Dominga project.
This milestone comes amid various legal proceedings currently underway, including two appeals filed by the company itself, and is part of a procedural dispute regarding formal aspects of the enforcement of previous rulings,
without challenging the environmental merits of the project.
In this regard, Francisco Villalón, Andes Iron’s Manager of Corporate Affairs and Sustainable Development, stated that “throughout the extensive environmental assessment process, it has been demonstrated time and again that the project complies with the law and meets the highest environmental standards. The ruling by the Antofagasta Court of Appeals allows us to reinstate the project’s environmental permits and, with that, to continue moving forward with construction.”
Villalón added that “we believe it is possible to generate more development, more growth, and thousands of jobs. We believe in environmental justice in our country and in the rule of law.”
With this ruling, the Dominga project resumes its roadmap in a scenario where the judicial review remains ongoing, reaffirming the validity of its environmental permits and the continuity of an initiative that has been thoroughly evaluated within the institutional system.
